As of 1 September 2020, there will be a change in the disclosure of inspection results of the NVWA. Both the NVWA Publication Policy Rule and the Decree on the Disclosure of Supervisory and Execution Data will enter into force. The decree offers the NVWA the possibility to publish inspection results - much more quickly than before - by name. For example, the inspection results of all catering establishments in the Netherlands will become visible.
In recent years, the results of various product surveys have already been made public, for example of inflatable swimming pools, hoverboards and breakfast cereals. Also for some companies (e.g. indoor playgrounds, fish processing companies and catering establishments in the 4 major cities) - the inspection results are already public.
The result of the digital re-inspection no longer influences the judgement of the first inspection. The digital re-inspection is now an inspection with its own judgement. The Safe Food Declaration (for catering inspections) is no longer valid.
The Decree on the Disclosure of Supervisory and Execution Data provides a different legal basis for disclosure. For the time being, only the inspection results of the fish auctions, the catering industry and the product research product safety will be made public on the basis of this Decree. What changes is that the view, as the entrepreneur could submit up to now in response to the disclosure of the inspection results, will lapse. Publication of the inspection results can therefore already take place after 2 weeks. Objection and appeal are still possible. The inspection results of all catering establishments in the Netherlands (not only the 4 major cities) will be made public, including the locations of the formula companies.
