New law aims to better protect labor migrants

The Dutch government has approved the Admission of Labor Provision Act. Under this new law, employment agencies and other companies that supply workers may only do so if they are officially registered. Companies hiring staff – including those in the food industry, where many labor migrants work – will soon be allowed to use only approved agencies. The aim: to prevent abuse and strengthen the protection of labor migrants.

Level playing field for businesses

With this law, the government wants to protect fair employment agencies from rogue competitors. Outgoing Minister Paul of Social Affairs and Employment said: “Given the persistent problems, this law is really necessary. There is no other way.” The measure follows recommendations from the Roemer Committee, which called for stricter regulation of the temporary employment sector to improve the position of labor migrants.

Employment agencies will need to meet several clear requirements: provide a Certificate of Good Conduct, deposit a financial guarantee, and demonstrate compliance with relevant legislation. Regular inspections will ensure that fraudulent practices do not return.

The Senate voted on the proposal on Tuesday, 11 November. A broad majority of parties – including GroenLinks-PvdA, VVD, CDA, D66 and SP – voted in favor. BBB, FVD and several smaller factions opposed the bill.

Concerns about administrative burden

Not everyone is enthusiastic. The CDA warned of a “huge administrative burden” and questioned whether small, trustworthy companies might be squeezed out. The SGP pointed to “structural extra regulatory pressure” and higher costs. Minister Paul stressed that the government plans to scrap five hundred rules before the summer of 2025 to ease the pressure on entrepreneurs.

Supervision will determine success

The law will be implemented gradually and is not expected to function fully until 2031. D66 stressed that its success “stands or falls with supervision.” The SP called for faster and tougher enforcement against malpractice. The ChristenUnie underlined the importance of proper registration and decent housing for labor migrants, who often live in poor conditions.
