Food remains patentable

On 25 March 2015, the highest appeal chamber of the European Patent Office issued a ruling on the patentability of classically bred crops, in this case broccoli and tomato. This type of patent will remain permitted; according to the highest appeal chamber, the agreements in the European Patent Convention pertaining to the ban on patenting essential biological processes (classic plant breeding) does not apply to the products which may result from them (such as seeds, plants and fruits). In an effort to gain more public support for a ban on patents on plants and animals and hence to increase the political pressure, Bionext has launched a Dutch campaign which translates as ‘Have a heart for biodiversity, no patents on life’.
