As of January 1, 2024, the rates of the Dutch Food and Consumer Product Safety Authority (NVWA) are set to rise. These rates encompass various activities, including inspections, re-inspections, system supervision, certification, and sampling and analysis for businesses and individuals engaged in commercial activities.
Annually, NVWA rates are adjusted to account for rising wages, prices, and changes in regulatory oversight. While there is an 8% increase in wages and prices this year, this percentage does not precisely align with the rate hike scheduled for January 1, 2024. The increase is also influenced by the goal to make rates cost-covering, as stipulated in the coalition agreement Rutte IV, and developments in regulatory oversight. The cost-covering measure only affects rates that were not previously cost-covering.
On September 26, 2023, the College of Appeal for Trade and Industry (CBb) made a ruling regarding NVWA rates, impacting the year 2024. The cost items unjustly included in the rates, as per the ruling, remain open for the 2024 rates. Once the effects of the ruling are definitively calculated, rates will be retroactively adjusted. This means that unjustly included cost items, such as collected fees, will be refunded.
