Alarming: websites ignore privacy rules

  • 25 May 2023

A survey conducted by the AVG Foundation shows that almost 30% of the analysed websites do not have the privacy statement in order. The sample was carried out exactly five years after the introduction of the AVG among almost 1,400 Dutch websites of a variety of organisations in ten different industries.

Smaller organisations in particular score lower. Almost 30% of organisations do not have a privacy policy on their website or these regulations are not made easily accessible. Financial service providers, schools and catering establishments score particularly lower. Positive outliers are organisations in healthcare and real estate. Charitable organisations emphasise the importance of privacy by often posting a privacy statement.

The AVG has been in force for five years. With the increase in cyber attacks, data breaches and identity fraud, its importance is becoming increasingly clear. The AVG Foundation and Implementing Organisation AVG Programme support (business) organisations via an online platform to comply with AVG requirements.

Lack of privacy statement worrying

According to Maarten Roelfs, chairman of Stichting AVG, the lack of a privacy statement five years after the introduction of the AVG is worrying. "A privacy statement is essential to promote transparency and trust between organisations and consumers. Consumers increasingly value good handling of their personal data," Roelfs said. "Especially smaller organisations that score less well on this are of concern. They have as much responsibility as large companies to ensure the privacy of their users."

"Data, including personal data, is intertwined with the modern world. The AVG plays a crucial role in protecting consumers, citizens and members. Organisations should not underestimate the value of trust, as it can cost customers, revenue and members. It is important that they implement the AVG legislation properly. Privacy protection should not be an optional add-on, but a fundamental principle for successful organisations."
